3. Personal Data

Personal data means any information relating to an identified or identifiable natural person. This includes, for example, information such as your name, age, address, telephone number, date of birth, email address or IP address. Information for which we cannot establish a connection to your person, or can only do so with disproportionate effort, for example due to anonymisation, is not considered personal data. The processing of personal data (e.g. collection, retrieval, use, storage or transmission) always requires a legal basis or your consent. As part of certain functions of our website, in particular the online hearing test, special categories of personal data within the meaning of Art. 9 GDPR (in particular health data) may also be processed.

4. Data Processing When Using Our Website

We generally collect and use our users’ personal data only to the extent necessary to provide a functioning website and our content, services and information. When you access and use our website, we collect the personal data that your browser automatically transmits to our server. This information is temporarily stored in a so-called log file.

The following information is collected without any action on your part and stored until deletion:

  • IP address of the requesting device
  • Date and time of access
  • Name and URL of the file accessed
  • Website from which access was made (referrer URL)
  • Browser used and, where applicable, the operating system of your device
  • Name of your access provider
  • Amount of data transmitted in bytes
  • Source/referrer from which you accessed the website
  • The data listed above is processed for the following purposes:
  • Ensuring a smooth connection to the website
  • Ensuring secure and convenient use of our website

The legal basis for this type of data processing is Art. 6(1)(f) GDPR. The processing of the above-mentioned data is necessary to provide the website and enable its secure and convenient use and therefore serves to protect a legitimate interest of our company. There are no overriding interests of the website user, meaning that the interests of the website operator prevail. As soon as the above-mentioned data is no longer required to display the website, it is deleted. The collection of data for the provision of the website and the storage of data in log files is essential for the operation of the website. Consequently, users do not have the option to object to this processing. Further storage may take place in individual cases where this is required by law.

As part of the online hearing test, special categories of personal data within the meaning of Art. 9(1) GDPR may be processed, in particular information about your hearing ability and the results of the hearing test. This data is processed exclusively for the purpose of conducting the hearing test, creating an individual product recommendation, providing the test results, referring you to a hearing aid acoustician (if requested by you), and, where necessary, initiating and processing a contract. The processing of this health data is based on your explicit consent pursuant to Art. 9(2)(a) GDPR. Where the processing is also necessary for the implementation of pre-contractual measures or the performance of a contract, it is additionally based on Art. 6(1)(b) GDPR. You may withdraw your consent at any time with effect for the future.

5. Data Processing When Contacting Us

If you contact us via a form on the website or by email, the information you provide (name, email address, telephone number, if applicable, and the content of your enquiry) will be stored by us for the purpose of processing your enquiry and in case of any follow-up questions. Data processing when contacting us is based on Art. 6(1)(a) GDPR and Art. 6(1)(b) GDPR, based on the voluntary consent you provide when submitting the enquiry. Once your enquiry has been dealt with and the relevant matter has been conclusively resolved, the personal data processed for the purpose of contacting us will be deleted. Further storage may take place in individual cases where this is required by law.

6. Data Processing When Purchasing Goods

Our website allows users to purchase goods by providing personal data. The data required for this purpose is transmitted to us and stored. The following data is collected as part of the ordering process:

  • Name
  • Address
  • Date of birth
  • Email address
  • Payment information

Your data will be passed on to the shipping company commissioned with the delivery, insofar as this is necessary to deliver the goods. For the processing of payments, we transfer your payment data to the credit institution/payment service provider responsible for processing the payment. These companies may use your data for order processing, but not for other purposes. The lawfulness of data processing when purchasing goods is based on Art. 6(1)(b) GDPR. Once the contract has been fully performed and the purchase price has been paid in full, your data will be blocked from further use and deleted after the expiry of the statutory retention periods under tax and commercial law, unless you have expressly consented to further use of your data. Further storage may take place in individual cases where this is required by law.

7. Data Processing When Creating a User Account

Our website allows you to register by providing personal data. The data processed is used to create an individualised user account that allows you to access certain content and services on our website. When creating a user account on our website, we process the following personal data:

The processing of the personal data described above is based on Art. 6(1)(a) and Art. 6(1)(b) GDPR, based on the voluntary consent you provide when registering. Once the user account on our website is deleted or amended, the data processed during the registration process will be deleted. Further storage may take place in individual cases where this is required by law. As a user, you have the option to delete your registration or user account at any time.

8. Disclosure of Data to Third Parties

Your personal data will not be transferred to third parties for purposes other than those listed below. We only disclose your personal data to third parties if

  • You have given your express consent pursuant to Art. 6(1)(a) GDPR,
  • This is legally permissible and necessary pursuant to Art. 6(1)(b) GDPR for the performance of a contractual relationship with you,
  • There is a legal obligation to disclose the data pursuant to Art. 6(1)(c) GDPR,
  • The disclosure is necessary pursuant to Art. 6(1)(f) GDPR to safeguard legitimate business interests or to assert, exercise or defend legal claims, and there is no reason to assume that you have an overriding legitimate interest in preventing the disclosure of your data.

If you expressly request or consent to this, the results of your online hearing test may be transmitted to a cooperating hearing aid acoustician in order to enable further consultation or provision of hearing aids.

9. Cookies

  • Right to restriction of processing (Art. 18 GDPR): You may request restriction of the processing of your personal data where the accuracy of the data is disputed by you, the processing is unlawful, we no longer need the data but you require it for the establishment, exercise or defence of legal claims, or where you have objected to processing pursuant to Art. 21 GDPR.
  • Right to data portability (Art. 20 GDPR): You have the right to receive personal data that you have provided to us in a structured, commonly used and machine-readable format, or to request that it be transmitted to another controller.
  • Right to withdraw consent (Art. 7(3) GDPR): You may withdraw consent you have previously given to us at any time. Withdrawal of consent means that we may no longer continue the processing based on that consent in the future.

11. Data Security

We undertake to treat your personal data confidentially. To prevent the manipulation, loss or misuse of your stored data, we implement extensive technical and organisational security measures, which are regularly reviewed and adapted in line with technological developments. However, we would like to point out that, due to the structure of the Internet, it is possible that data protection rules and the security measures described above may not be observed by other persons or institutions outside our area of responsibility. In particular, data disclosed without encryption—for example, by email—may be read by third parties. We have no technical control over this. As a user, you are responsible for protecting the data you provide against misuse by using encryption or other appropriate measures.
